The 5th Lecture of the Crypto Asset Research Project Held

On Friday, August 27, 2021, the 5th lecture, "DeFi - The Present and Future of Decentralized Finance and Crypto Asset Legislation -," was held online. We invited a lawyer from ZeLo / Foreign Law Joint Enterprise, who gave a lecture that touched upon the overall picture of crypto asset legislation, recent amendments, and specific case studies.

  • Mr. Hiroto Shimauchi (Lawyer, ZeLo / Foreign Law Joint Enterprise)

  • After graduating from the University of Tokyo, Faculty of Law in 2017, he passed the preliminary bar examination. He was registered as a lawyer in 2019 (admitted to the Daini Tokyo Bar Association). He joined ZeLo / Foreign Law Joint Enterprise in 2020. He is involved in organizing and structuring legal schemes for many businesses that use blockchain technology. Since June 2021, he has been a member of the screening committee at CAMPFIRE SOCIAL CAPITAL Inc. His publications include "The Strategy and Practice of Rulemaking" (Shoji Homu, 2021), "Japan in Space - National Architecture, Policy, Legislation and Business in the 21st Century" (Eleven International Publishing, 2021), and the article "Stablecoins, DeFi, and CBDCs" (Kin'yu Shoji Hanrei No. 1611, 2021).

First, Professor Jiro Tamura (Professor, Faculty of Law, Keio University) gave the opening remarks, explaining the significance of the Crypto Asset Research Project and introducing Mr. Shimauchi. Next, Mr. Shimauchi explained the current state of crypto asset legislation, focusing on the Payment Services Act and the Financial Instruments and Exchange Act, and discussed the necessity of regulation. He then described the types and features of DeFi (Decentralized Finance) and explained future legal regulations and the movements of regulatory authorities in light of DeFi. Finally, a Q&A session was held to answer questions from the audience.

Through this project, by providing opportunities to hear directly from practitioners with deep knowledge of crypto assets as guest speakers, we aim to deepen the understanding of the potential that crypto assets can bring to society and to promote research and dissemination in the crypto asset industry.
