A joint workshop by Keio University and the University of Washington on FRAND litigation in Germany and Europe (litigation concerning standard essential patents for which a FRAND declaration has been made) was held via a Zoom meeting on Friday, November 27, 2020.
The moderator, Professor Toshiko Takenaka (University of Washington and Keio University), participated from the United States, while keynote speaker Dr. Matthias Zigann (Presiding Judge at the Munich I Regional Court) joined from Germany. Many of the discussion participants from various universities, courts, government agencies, and companies took part from Japan. Following Dr. Zigann's keynote lecture, a lively Q&A session and discussion took place, kicked off by a presentation of issues by Professor Yuko Kimijima of the Faculty of Law.
Through the courtesy of Dr. Zigann and with support from the Faculty of Law's subsidy for international exchange, a recording of the keynote lecture portion of the workshop is being made available to the public with Japanese subtitles. Although Dr. Zigann has been involved in important FRAND litigation in Germany as a judge, this lecture represents his personal research and reflections. He presents his personal views after organizing and introducing court precedents and academic theories in Germany and Europe, making it a very important lecture for research and practice related to standard essential patents.
